Terms and Conditions
IMPORTANT LEGAL NOTICE ATTENTION

This legal notice applies to the services and supply of products of Hello Darling Photography and you (the client). Please read these terms carefully before booking a Photoshoot. By booking any service with Hello Darling Photography, you indicate that you are accepting these terms.
If you do not accept these terms, please do not book.
This notice is issued by Hello Darling Photography LTD, a UK registered company #12488096. Registered at 24 Market Place, Otley, West Yorkshire, LS21 3AQ.

Copyright

The 1988 Copyright Act assigns the copyright to the Photographer. It is contrary to the Act to copy, publish, reproduce or store images electronically, unless the express permission of Hello Darling Photography has been purchased. If permission is granted, then transfer of the copyright commences only once payment for the copyright has been made in full.

The Client may not (either personally or via a third party) alter or add to or manipulate a picture by means of computer or any other technique or reproduce a picture in whole or in part as an element within, or as a montage with, another picture.

Display

The photographer reserves the right for any photograph created during sessions to be displayed in the studio, portfolio, or in any other advertising directly associated with Hello Darling Photography. 

Email

Unless otherwise requested Hello Darling Photography will use your email address to inform you of future events and offers, but will never pass on this information to any third parties.

Ownership

Any negative and/or digital files shall remain the sole property of the Photographer(s) at all times. All completed prints and products shall remain the property of the Photographer(s) until full payment is received.

Force Majeure

In the unlikely event of total photographic failure, injury or sickness beyond Hello Darling Photography’s control, their liability shall be limited to a full refund of all monies paid. Your statutory rights are not affected. Hello Darling Photography has full Public Liability and Professional Indemnity Insurance.

Booking Fee

A booking fee is required at the time of booking in order to secure the time, date and services of Hello Darling Photography.  

Cancellation

Deposits are non refundable and non transferable.

If Hello Darling Photography has to cancel the appointment for reasons beyond their control (death, injury, sickness, etc.), their liability shall be limited to a full refund of all monies paid. If the Client cancels the appointment with 7 or more days before the scheduled photoshoot slot, the photographer shall grant the option of rescheduling the appointment.
for cancellations made 7 days or less before the scheduled photoshoot slot, the photographer is under no obligation of rescheduling.

Lateness

The Client and Hello Darling Photography agree that cooperation and punctuality are essential to accomplish the goals and wishes of all parties.
Lateness of any appointment will be taken out of appointment time. If the client is more than 30 minutes late your deposit can be forfeit and you risk your appointment been g cancelled. Deposits lost due to lateness cannot be transferred to another appointment date.

Sales

All products specification are as described on the product description, shown before purchase. The company will review the product specifications occasionally so reserves the right to amend the specification of any of our product(s) without prior notice.
All bespoke/personalised products will be subject to client's approval via a proofing. Products will only be ordered once the client has informed the photographer they are happy to proceed.
It is the client's responsibility to acknowledge any errors that may be present in the proofs occurred during the creative designing process, and request for them to be rectified by the photographer.
Hello Darling Photography cannot be held responsible for mistakes that were not spotted by the client after being shown the product proofs, before they were sent to production.

BACKUP

It is the client’s responsibility to ensure that the digital photographs are adequately backed up after their delivery  (e.g. on client’s PC or external hard drive). In case of loss or damage of the images, Hello Darling Photography cannot guarantee that the photographs will remain available after a year. Your gallery will expire after this time.

Product Delivery

Products other than digital files are bespoke so take an average of 4 weeks to create from the point when the Client approves the order of the product. To allow for post-production and editing time Digital Files will be ready to view within 14 days after the photoshoot.
Prints and additional products are subjected to be collected from the studio by the client.
When delivery is requested, there may be additional charges.

Creative Licence

Hello Darling Photography shall be granted creative and artistic licence in relation to the choice of locations and poses used. Hello Darling Photography’s judgement on photographic style and the number of photographs taken shall be deemed correct. Some photographs may not be possible due to changes of the weather and the availability and willingness of subjects. Hello Darling Photography will do their best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.

Postponement Due To Adverse Weather

If the appointment has to be cancelled by Hello Darling Photography due to adverse weather conditions a new, mutually agreed appointment will be made. However, if the Client would like a Booking Fee refund, this will be granted.

Complaints

All complaints should be raised by the Client directly to the Photographer in writing within 14 days of the occurrence which gives rise to the complaint. The Photographer will consider the complaint and shall provide a response to the Client within 14 days of receipt of that Complaint. In the unlikely event of an unresolved complaint the Client may request the SWPP (Societies of Wedding and Portrait Photographers) to mediate but only on the basis that its decision shall be final and binding upon both parties. The alternative to the latter is that the Client will need to consider legal action.
